So Mass Effect 2 for the PC is already out and up for download.

-No SecuROM crap

-No GFWL crap

-No other DRM crap

-Easy as hell installation (compared to GFWL and all that)

So how do publishers actually expect people NOT to pirate given that pirated copies are better than retail in every aspect?

So if this is why piracy is so high, then why do games that don't contain the following three items still get pirated at rapid rates? World of Goo, which is price low and contains no real limitations like those you mention still got pirated uncontrollably, enough so that the developer publicly spoke about it. Why do console and handheld games get pirated? In fact where is there any correlation between DRM, SecuROM, GFWL and high piracy rates? It seems to me that pirates don't discriminate in that manner at all.

World of Goo had 90% piracy rate within the first few weeks. It is well known that piracy is extremely frontloaded while sales on the PC draw out forever. I mean hell, in thet first month I had 3 copies of WoG pirated, now over a year later, I have 2 copies on Steam and 1 on WiiWare.

As for DRM leading to piracy, check out what happened with SPORE. I mean looking at the SPORE "new users over last 24 hours," That is users who have a legal copy they can register to the Sporepedia, is at 1,243. I think total is around 3.5 mil. Meanwhile after those 1.7 mil piracy cases in 3 months, until EA patched out their shitty DRM more or less, hasn't increased nowhere near at the same rate.

That's not justification though. You try to give these reasons as to why piracy is so high and attempt to justify it, and then shrug your shoulders when an indy developer that trusted gamers to make the right decision on a budget game do not put any DRM in and still get slapped in the face and had to file for bankruptcy. If DRM is the reason why piracy is so high, then why did World of Goo get pirated so much? Why did you pirate it three times? Do you have yet another excuse for it?

Let's be real here. Piracy is full of lame excuses trying to justify the whys, but in the end is merely a case of not being able to or simply not wanting to pay for a product. It's inherent worth is irrelevant, as is it's quality. It's a matter of availability. Piracy is widely available and PC games are marketed to the type of group that is knowledgeable enough and willing enough to pirate in the first place. That is why Nintendo doesn't need to do a damn thing to combat piracy and the PC developers do.

The next time you ask yourself why your precious PC games have to be "dumbed down" for consoles and thus dumbed down for the PC, remember which consumers are still buying the games, and you'll notice that piracy is the cause of the radical shift away from PC only development for the formally biggest names in PC development. You are a huge contributor to your own dissatisfaction with PC gaming.

There is no need to lie here, they never went bancrupt and the link you provided earlier was the publisher that went bancrupt but if you hadnt lied and twisted the truth you wouldnt have an argument would you?

The publisher going bancrupt is hardly because of world of goo being pirated.

I find it amusing and ironic that you say that piracy is full of excuses and justifications when you your self lie flat out to justify the opposite.

That wasn't a lie. It was an honest mistake on my part. I didn't read enough into it when it was announced and figured since 2D Boy self published the game on the Wii, they did the same on the PC. I wasn't aware they required second hand publishing on the PC for their game since that's an almost foreign concept for so many PC games. That's all. That part of my argument is retracted.

ok then i will buy that misstakes happen and we all do it on a daily basis.

I have another question for you, how do we prove that the 90% downloading of the game isnt the reason the game went so high up on the charts as it did?

another thing i want to point out is that pirating and downloading are 2 different things all together, a pirate is someone that makes money of the software while a downloader isnt making any money so i think we should stop using the word pirating all together because it gets confusing when people use it as we dont know wich group of people the person using the word is thinking of.

I agree with you to stop pirates (people who download games and sell them) but I am not agreeing on the downloaders.

I also think/have a theory that there are 2 groups of downloders (not speaking in absolute terms here and there should be some overlap between the two).

Group 1: They have been downloading/copying or sharing games since the NES/C64 era and are big spenders in this industry like many people in this site that dowload and buy the originals of the games that they like. (like me I have been copying/sharing since NES/C 64 era and I buy all games that I like wich through the years is a very big gaming library)

Group 2:; Is the new generation that is the young people growing up with downloading as a normal thing and i think its here that you find the biggest group that only downloads and never buys.

My theory is that group 1 grew up with making backup copies and sharing with friends wich was very common to do up untill downloading became viable and they hae supported the industry all the way, they shared/swapped  games with their friends (usualy their backup copies) to gain acces to more games then they could afford and sometimes even made plans with friends about wich games to buy so you didnt buy the same thing. This group is probably buying more games then the average gamer or console user (atleast thats true for me and my surroundings)

while gruop 2 grew up with the Internet and the ease of getting what they want and in turn they never really shared their games with anyone not even friends and they hardly biuy anithing and they think they are intetitled to anything.

Ive seen the difference in theese 2 groups around me and i was curios if its the same in other places?

Software piracy is actually copying something and selling it for a profit. If you download something and do not sell it- it is not technically piracy. It is a breach of copy right. Stealing is physically taking something that does belong to you. Piracy and breaching copyright are both stealing related offences.

Either way the developers lose out on revenues for their work. Both breaching copyright and piracy are criminal offences if you get caught and prosecuted by the full extent of the law.

Piracy and copyright infringement are adversely impacting on PC game sales. Stolen PC games heavily out number legitimate copies ofn games. Game developers are well aware of this and are releasing fewer console games on PC.

Anyway most PC games have very high piracy rates. Online PC games would have lowest piracy rates because you have to have the genuine copy in some cases to be able to play the games online. Mandatory online registration of all PC games would reduce piracy rates.

Thats not really true for most European countries as downloading is not illegal here in most countries but it is in the US.

Even in the UK there is not any precedense (yet) that makes downloading illegal.

I dont agree with you that its stealing it just isnt as you dont take anything from anyone.

How do you prove that the high number you are talking about isnt multiple download from one and the same person?

This is especially very common with pc games where you might dowload a game several times before you can make it work and that true for a techsavy guy like me, take a less tech savy guy and you have evem more downloads for the same game before they can make it work on their pc if they ever get it to work.

How do you prove that the number of dowloads isnt also contributing to the legitimate sales?

While laws certainly vary, and in some cases you are right downloading is not illegal in the case of the UK it is. Not trying to make a point- just correcting an inaccuracy.

None of those cases are proof my friend.

In the first case there is no mention that the fined people were downloader only.

In the second case thats davenport lyons and you can add ACS (I think thats their name) too but they fine people left and right, there is no courtcase that makes it illegal to download yet!!! The UK is going to present a law this year that supposidly is going to ban downloading but its not illegal yet.

I know this becaue of the company in your second link because they try and scare people to pay and it works good for them (have been following them for 2 years now) they even tried to fine an 60+ year old couple for downloading gay porn and they never even had the ability or knowledge to download.

There is no courtcase in the UK forbidding downloading period.

Here is a link you can go through to learn the truth about davenport lyons and ACS

http://www.slyck.com/forums/viewtopic.php?t=44092

Here is another one that shows what tactics they use and that gaming companies dropped them because of their tactics:

http://www.slyck.com/forums/viewtopic.php?t=45374

Here is a link with the truth about your link concerning the pinball game:

http://www.slyck.com/forums/viewtopic.php?t=44018

That case was won by default becasue no one shoved up to contest it.

Davenport Lyons and ACS are scam corporations funded by the copyright companies and use illegal scaring tactics to scare people into paying even when they are innocent cause they cant afford court cost and lawyer costs (note that i am not sayin all of the are innocent).

They havent yet brought someone to court that contests their claims and as such there is no case where dowloaders only has been convicted for downloading. But I have a feeling that will change this year as UK laws are going to change.

Hell even the administrator of OINK went through a courtcase and was freed:

http://www.slyck.com/forums/viewtopic.php?t=50305

http://www.slyck.com/story1894_Prosecutor_OinK_Administrator_had_over_300000

If you cant convict an administrator of a webbsite that was one of the biggest and best quality in the world and also had over 300 000 $ that was given to him through donations then you cant convict a downloader only.,

Even if the new laws pass its not even sure it will hold as EU laws dont support this YET, recently Telia denied the police in Sweden to acces information about Swedtorrents and their users even though there is a law in Sweden that gives the the right to this info, they denied them with the basis to the EU law. The case is ongoing so we will have to wait and see how it turns out. So even if UK passes a law that will make downloading illegal then it might not hold as the EU law superseedes the UK law but only time will tell.

Now everything you been saying has been part of the propaganda/brainwashing  theese companies have been doing and as you can see with your self it has worked very good but its not the truth. So far there hasnt been one downloader that has been taken to court and lost YET but i am sure it will come soon enough.

Edit: Here is the link and a short draft of the old couple that was accused by dvenport lyons of dowloading gay porn:

http://www.guardian.co.uk/money/2008/nov/28/internet-porn-bill-mistake

A Hertfordshire couple in their 60s were horrified to receive a letter last week from a London firm of lawyers accusing them of dowloading a hardcore gay porn movie. It demanded they pay £503 for "copyright infringement" or face a high court action. The 20-page "pre-settlement letter" from lawyers Davenport Lyons, acting on behalf of German pornogaphers, insisted they pay £503 to their clients for the 115 minute film Army Fuckers which features "Gestapo" officers and "Czech" farmers.

The bewildered couple contacted Guardian Money. "We were offended by the title of the film. We don't do porn - straight or gay - and we can't do downloads. We have to ask our son even to do an iTunes purchase."
