But there's over 1.2 million owners of HOTD: overkill, but when speaking about sales, only people have lawfully bought one instead of downloading it are counted.

Yes I'm well aware how the sales are counted thanks. For THOD to be a million seller it would have had to have sold 1 million copies. It hasn't. Thus it isn't a million seller.

Nintendo has tried a lot to stop it, though, after a day or two homebrewers enable it again. Really there isn't anything Nintendo CAN do about it. They cannot ban you from online due to the system not being unified, plus Online isn't the same value as it is on the 360 anyway. So really it isn't that Nintendo isn't trying, there just isn'ts a solution with their current setup.

Even if the PS3 was hacked, the size of the games is just too massive, even if they were shrunk. Not only that, but there would have to be a HDD option, as Blu-Ray isn't pirate friendly.
