Dude, you misuderstand. It's the games that are under contract as they are Sony IP's being developed by Insomniac. Sony have the final say on everything that happens with them. It is the same scenario with Ready at Dawn with GOW: CoO and Level 5 with White Knight Chronicles/Dark Cloud etc... the games are under contract/funding not the company.

Simply put. You don't make contracts with games, you make contracts with the studio that makes the games.

Remeber when Bioware first annoucned Mass Effect? The game was exclusive because Bioware had an agreement with Microsoft to make 3 games for them. Microsoft didn't have control of the company outside of whatever was written on the contract. This is likely the same case for Insomiac games. The studio itself is free to do whatever they want outside of whatever obligations were made in the confines of the agreement. Thus, the meaning of a second party (kinda) developer or maybe better put as "an independant dev that is under contract with a 1st party publisher".

No, Sony owns rachet and clank etc etc. If sony comes to you and says, We will fund the making of the game, We own the game but we wish for you to make it. If you decided to make the game, sony still decides what to do with the game. Mass Effect there was a deal. Microsoft doesnt own those IPs. However Sony owns pretty much everything insomniac is known for. If they made a 360 game people wont even know it was them. Sony should buy sega and make them churn out massive amounts of games for only the PS3.

I'm confused as to what you're getting at.

Yes, Sony has rights to those I.Ps, but it's not because Sony created it. Insomiac created those I.Ps and the agreement was in all likelyhood to to fork over the IP rights for funding or job security (aka a contract in which Sony pays them to make games). 

It's really not an argument. Anyone believes that insomiac games is developing exclusively on Sony platforms (as well as openly sharing their dev tools for the PS3) out of good will and without contracts/deals in place are fooling themselves.

^ I think the "big news" was that Insomniac was voted the best place to work in California. They also noted in the release that they are working on an unannounced title exclusively for the PS3, but we already knew that. I think some sites hyped this as a bigger deal than it was.
