Forums - Sony - SONY are gonna sue

i would like to see an adverts saying "war KILLS!" and show british and american soldiers. that would make perfect sense unlike this advert.

looks like priorities have been mixed up. it seems they have forgotten about:

obesity, alcohol, pollution, famine, forced marriages, gang wars and many more.

as gamers we should unite and e-mail this stoneage society, let our voices be heard and shut these idiots up....my blood boils aaaaagggggghhhhhhh!

Pathetic.

Why don't they target something that is actually dangerous?

Sony is the known traditional games leader from the PS2. Nintendo is the current leader, but the Wii isn't known for traditional controllers, as well as promotes more than sitting around.

As for the suing part, there's nothing they can really bring to court.

Chances are they can sue. It is like saying some celeb does coke. If they don't really do that then you are just slandering their image. Same thing here. They are tying the PS3 to death and fatasses. This could be seen as slandering the image of the playstation. They could sue for quite a bit.(going off US laws BTW)

slander. unless they can prove playing games causes death.

sue for saying if you play video games and "do nothing else" you risk becoming fat and unhealthy....

methinks sony will lose that court case, as its patently true.

they might be able to get them to change the ad with a little pressure i guess so that it has a generic mock up of a controller, but nothing more.

But its not really saying that, what the advert says is more along the lines of "Play games and you will die". Also with it showing the PS3 pad it could give negative press and reception on the PS3, i guess well see how sony react when the next UK numbers are in.

"Well, we would've sold more, but the Beeb said our product kills people."

Its interesting because if PS3 sales drop rapidly in the UK... sony could sue for millions probably.

only if they can prove the ad was to cause the sales slump and not something like the economy or price

sharky & max - Slander is only covered by personal image, not corporate law. This is why commercials can directly say how their product is better than another, use the competitor's product with the name blurred out in comparison, etc. Sony wasn't specifically named, so they won't have enough proof of being a target of suggested slander.

@bardicverse

yes they can since the advert is ruining the image of the company product on very weak if next to nothing information. the advert could have used any controller or even made a fake 1 but they didnt. legally they have made a very harsh and bold statement, if they go to court they have to prove video games are directly linked to death! all sony needs to do is give stats to show how many ps owners have died from actually playing their console.

the advertisement company will also have to justify without discriminating a certain company why they used that prop and didnt think it through. it is commonsense, even well known programmes like Simpsons use fake brands!

this advert may also bring devs etc together and give a big FU to those responsible for the advert.

bottom line is, presidents, prime ministers, celebs, hospitals, cancer research (ps3 folding at home) facilities, airlines, gyms (dance mats and wii sports etc) promote/ accept/ back these games and consoles, the company wont have a leg to stand on.

You are confused there. You can say yours is better. That is okay because you are fighting for market share. But you can't say. "The PS3 is great, the xbox 360 is a peice of trash designed by animals" Sony would be sued ASAP. Just saying "we are the best brand out there for the consumer" is not slandering anyone's name or product. Also unless you are given promission to use a company's product in anything, you cannot use it. If you do, the label must be blurred as you said. Sony can sue because they used their product. It is as simple as that. Doesn't even matter if it said. "Gaming will increse the size of your penis" No matter how good it is. They can technically sue.
