my copy of mgs4 has taken me back to the xmb screen, where its showing the msg4 disk. it does this every time after then cutscene where vamp is shot in the head, has this happen to anyone before. do i need to get a new copy of the game to get past this point or what?

It didn´t happen to me...before jumping to conclusions, don´t you have a friend who owns MGS4 as well?...You could borrow it to see if it´s a problem with your disc.

i was told to try skipping the scene to see if that worked and it didnt. i bought the 40gb ps3 and upgraded the hdd to 250hdd. no problems with any other ps3 game, i am really liking mgs4. none of my other friends has a ps3, only xb 360 owners, so i cant borrow a copy to see if its the game. should i just exchange the game and try another copy of the game.

Hmmm, try a different copy (go to the store and rent one). Or get one from a friend. You could try uninstalling the game (deleting the game data) but keeping your save file and see if that helps.

If none of those work, you might have to do a system restore. This really isn't as bad as it sounds because you can back up anything on your HDD on an external drive, i.e. a flash drive or an external HDD. You can just keep your saves if that is all you care about. You can redownload anything on the PSN up to 5 times (excluding Warhawk and possibly GT5 prologue).

If THAT doesn't work, you are just plain screwed.
