It's their own decision to not sell it in German stores.

But it's always funny to hear the words ban or illegal in regards to games that don't get a rating.



It gets a physical release, so whatever. Just import it from one of the UK- or Austria-Shops (or any other country), if you want that game.



Not that i'd care.
But it's not banned. It could be sold without rating.
A game, movie, book... isn't even banned when it's on the BPjM Index. It's only to be sold from 'under the counter' then, but that's it.
Even 'Verbreitungsverbot' is 'only' asales ban. So in fact there's very few stuff that's really forbidden here.

They've done that actually. They banned Gears of War for being too violent. Germany are one of the worst western countries when it comes to censorship.

Germany doesn't censor any games. Only developers do that. If developers do it, then only to be able to advertise them and display them in stores. Microsoft and many other have a policy that they don't sell the game if it doesn't get an USK18 rating. However there is no law stopping them from selling games like Gears of War (which is btw. off the index: http://www.schnittberichte.com/news.php?ID=10863 making Gears 2 the only one to be still on it).

There are only very few games that aren't allowed to be sold and those usually contain extreme violence (Manhunt for example). Even then you are still allowed to own such games.

The agenda is "Japan is the most amazing country on the planet, the West is incredibly ignorant of its greatness", Australia happens to be a negligible factor in all of this, hence no mention in the thread title.
