I keep seeing people mentioning "Let's Plays", but this case seems to be a youtuber was given a copy to review it. He then had a copywright claim against them on the videos he uploaded from the copy they sent him.
Seems counter-intuitive...

Yep, playing video games is tough work. I'd like to see them play some classic NES. Put them on Ninja Gaiden NES stage 6-2.

Playing the games for at times hours a day every day, pulling "entertaining"(that part is of course up to personal taste) commentary from somewhere when playing and editing all that shit can definitely be considered work.

You call me ignorant? Good one. Thejimquisition videos aren't monetized on youtube. You do realize what an utterly pointless thing that is to say, right? That this is just a flimsy attempt at a defense? What does it fucking matter if Jim Sterling monetizes on Youtube or not, cause it doesn't change that Sony/Activision didn't try to take his ad revenue for themselves. It is even possible that Copyright claims like Konamis or Nintendos automatically activate the monetization on these videos even without creator consent, I'm not sure if that's the case though.
Yeah I'm sorry, I guess that Nintendos known Youtube policies don't exist. Have you ever worked in your life? Playing videogames while talking over it isn't work. It's not original content. Reviews, top 10s, discussions, analysations, etc. are original content (and thus work). Oh I have worked, I'm just not so petty and jealous that I start judging something I've never done as not qualifying as work. That's really just completely ignorant. Nintendo gave FREE download codes of Super Mario Maker to LET's PLAY only channels and you're saying this isn't an obvious mistake? Again, you forgot about Nintendos policies I guess. |
I don't understand the logic of today. Let's see here is what it sounds like to me. Everything should be free for me but people should pay me more. This is what has killed intelligent thought behind music and why music is stale as shit(everyone said the same thing with Napster). Now it's slowly killing the video game industry. I will say it again,I want shit cheap and free but pay me more money, is the millennial logic.
Every Youtuber who is bitching about Nintendo blocking them for showing content is basically mad because they do not feel they should follow rules and guidelines but in turn wants to be PAID by advertisers and want more suscribers for there work, sounds a little GREEDY by the YouTubers if you ask me

And I guess Nintendo feeling entitled to the revenue created from the Youtubers work is not greedy then, huh?
One of the major problem that people faces when they want to use Nintendo's content is that - Nintendo's brand is too strong to gain large - or sometimes even noticeable benefit from some Lets Players.
In addition, they have rooted fear of fan created contents - which is weird since they are turning blind eyes on the reason why they had fear in the first place.
I do have disdain for the strike-down however. Even though they try to control their image like Disney---
They are not cracking down enough to be Disney, while cracking down too much to the point where they can't avoid criticism and anger.

Nope not when you are using their product to help you gain subscribers. So you think it's okay for McDonald's to just steal potatoes from farmers to make their fries or pay them

Let's players usually either buy their games themselves or they are send to them by the companies exactly for marketing purposes, which makes the entire analogy mute.
That's exactly how advertisement works, even in other fields, and it works the same way for pretty much all other publishers as well, only Nintendo somehow feels that someone advertising their game for them is something that Nintendo should be paid for, when in actuality, at least in the big cases, it should be the other way around (like companies for instance pay for product placements in big movies).
