how long has this game been out and do they know about it? it's not like they will just say the word and it gets removed.

 

Nintendo has stopped games from going on to the market/or asked devs to change design of games before. one is a game that looked like toon Zelda and that got changed.

From my understanding, the Sanity meter from Eternal Darkness is a good explanation of this. Nintendo has the Sanity meter patented, and as such, another company cannot use "sanity meter", however, they could use a meter with similar effects with a different look and presentation without infringing on the patent. This way, the mechanic itself isn't patented so much as the name and look which is what I was talking about in my post.

Nintendo would likely win a claim against the game in the OP due to the similarities between the characters and Pokemon characters, however, gameplay elements would not factor into this decision.

Overall, the main problem is the lack of any automated infrastructure to send out and enforce claims which is likely due to the complicated nature of copyright claims on games.

But you do realize that the way that Youtube works is that the videos/audio gets claimed on behalf of Nintendo right? Like Nintendo doesn't go through each video and claim them... Youtube's algorithm does that instead by matching the video/audio that Nintendo has given them but it's nearly impossible to do that for games/apps... Nintendo's legal firm does do that however but it takes significantly longer because a person has to do that and not a computer...

How has that not been taken down yet? I remember some guy put up Pokemon Yellow on apple store and it got taken down pretty quick. I mean this is ridiculous. That marketing line is just like adding insult to injury.

The android and ios stores are jokes when it comes to IPs, i see countless final fight clones and other 100% copies of arcade games. Someone should sue google and apple

Nintendo is getting into the app game realm because analysts are claiming that its digging into their handheld sales. Thats a true threat.
