Sony is letting Spiderman appear in the Marvel universe movies, though.
Phil literally said that it could be done. He's the guy in charge, and Microsoft has put Xbox exclusive franchises on Nintendo before, including Banjo. If they'd make a full game for a handheld, they'd have no problem giving a character a cameo in a game about cameos.
They wouldn't have to own both consoles, just like a GBA owner didn't need an Xbox to be happy with Banjo GBA. I don't see a problem with Banjo, a previously Nintendo character, making a cameo in a game celebrating the history of both Nintendo, and gaming. And neither does Phil. Phil just confirmed that it's not. The only people that would stop this now are Nintendo and lack of demand.

With Sony's financial i'lls its in their best interest to let Marvel use Spiderman, because Marvel will more than likely make more money with him and do a better job with him. They really need the money or else they would've stood firm against giving Spiderman to them.
As for MS and Nintendo doing business, MS has done business with Tecmo and put Master Chief in DOA, so it could happen. I am just saying i'll believe it the day that it happens, thats all. Personally as a fan of smash i'd rather have Bayonetta, because there is no character like her in the game. Banjo is unique as well but Bayonetta to me is just badass and shes represented Nintendo better than I thought. When I get my Wii U I must have her game, kart and smash so I would be more personally inclined to want her in.
I see your point though. Lets hope Nintendo allows things to go smoothly if any of that is to be believed.
