That's the thing, MS isn't asking people to make a video review.

The videos just promote the product.

You fools do realize this is illegal, right? Specially u Mr Puggsly. This is NOT advertising! This is paying people to fool others who may value ur opinion. Mr Puggsly I understand u may like their products, and thats okay... but u cant b stupid enough to think this type of practice is acceptable... u know better thn that. Come on! The problem here is not disclosing ur getting paid for ur positive commnts! Simple as that. U ever heard a political ad? Whn they talk about a candidate ( whether ill or otherwise) they ALWSYS disclose the fact that is a PAID ad.

What? Except of course that at the begining of that infomercial it tells you it's a paid advertisment. It doesn't pretend to be an impartial, informative program and then try to sell you something. How is that so hard to see?


Whenever you see someone on TV eating a cheeseburger and smiling, do you get angry they don't put a caption saying "paid actor"?

1. Actually, if you look at the credits for a movie or TV show you'll notice that it actually has all of the companies that paid for advertising in the production. Just so you know.

2. There is a big difference in just some guy on tv eating a burger and a food critic giving the burger joint a raving review because he was paid to. This akin to a company paying people to put fake reviews on websites to make the product look better. Technically from a legal standpoint it's worse.

Your example is bad because MS isn't doing that.

They're simply getting people to make campaign videos that promote the product and doesn't say negative things about the product, not make reviews with perfect scores.

They're simply getting people to discuss the product and avoid saying negative things, not make a review.


They are telling people to promote there product and are not allowing them to say they are being paid to do so. What would you call someone making a video where they give an "impression" on a product? It's certainly not an add.

Advertising is not a review.

? This isn't about reviews.

"You may not say anything negative or disparaging about Machinima, Xbox One or any of its Games in your Campaign Video." Completely fine and to be expected  in advertising.

"You agree to keep confidential at all times all matters relating to this Agreement, including, without limitation, the Promotional Requirements, and the CPM Compensation, listed above." Not fine.

This is in violation of the FTC guidelines that call for full transparancy when an endorsement is made.

As long as people aren't being mislead, I don't see anything wrong.

So make a video talking about the console, talk about the games you're playing, and avoid shitting on the products. That seems like pretty straight forward advertising to me.

That's the point, people are being mislead by these youtubers because they are not disclosing the fact they are getting paid are not allowed to said anything that might be precieved as negative about the Xbox1. These youtubers have audiences who trust thier opinions and in effect they are being lied to by the youtubers by not having a disclaimer saying look I'm getting paid by MS and Machinma to promote the Xbox1 and I cannot say anything bad about it. If they were to do that then there wouldn't be a problem.



 

I'm going to be diplomatic here and assume some people just don't get it.
