They definitely had no say and even assuming they have the capability to make a patch, there's no way they could do it without Nintendo's permission.

It's not even if they had the permission to make a patch, its that a patch would have to be massive to change the game on such a fundamental level. It's adding an additional check for conservations and relationships. Even then, it probably isn't as simple as it sounds
I suspect the Tomodachi Life "Same-Sex Ban" decision was made more out of laziness than malevolence. From what I've gathered of the game, possible relationships are a big part of the game's code, so even the original glitch that allowed same-sex ones to occur didn't really work well. Making the game gay-friendly would require actual development work, and would cause as much negative press as being lazy would. So when faced with two bad choices, Nintendo just had to go with the easier one.
I'm still disappointed.
Don't think it is that big of a deal as people are making out of Tomodachi Life's marriage issue.

Serious question guys: could we potentially use the NFC figurines to send a message to Nintendo? Like, if we want Star Fox U, instead of just sending a letter and petition signatures, we create a similar movement with the letter and the social media and whatnot, but instead of signatures, we all mass buy the Fox and Falco figurines?
