If you think about what is in this game and the history of its predecessors, do you not think this game would have gone through scores of legal reviews? This isn't some buried code like hot coffee that may have been missed by a legal review, this is in the game, on a track listing, easily accessible and reviewable part of the game content.

My money is on mis-communication between Daz and the respective labels ('nothing but a cavi hit' was released by Da Dogg Pound on the Priority Records label, which is owned by Capital records who in turn is owned by Universal Music Group. C-Walk was released by Kurupt on the A&M label, which is also owned by Universal Music Group

Since he owns the masters, the record labels can't license the songs without his permission. They'd need his permission to use those songs themselves.

What the hell does HE need to give his music away for or need Cosign from Rockstar for? After that sh*t he thru with DeathRow and Dre. you think this he is giving away money??

& Dont forget Daz sued and won a 25 + mil lawsuit against Death row records as well.  

 

Rockstar will $ettle w/ Daz D. accordingly, no doubt.

Side note: How would patching out the songs help the situation? I swear fans are worse than a companies enemies. By patching out his songs they'd be admitting they stole them in the first place. His lawyers would have a feel day.

I'm not sure if this also applies to IP law, but generally actions intended to remedy the harm after the harm was brought to light ("subsequent remedial measures") are inadmissible for most purposes. Makes sense: if you're suing because the defendant's stairs were so dangerous they caused you to break your arm, it's better for society that the defendant repair the defect ASAP and sort out the mess later, rather than discourage such a remedy by making the repairs create the plaintiff's case for him.

 

 

Anyways, $4,000 seems rather low to me.

Things slip through the cracks all the time, especially with huge productions live GTA. I sincerely doubt there was ever any malice on the part of Rockstar, but I'm inclined to believe the rapper's complaint is legitimate.

You really shouldn't use someone else's art without permission. They will probably have to pay him more than their original offering. Although in court, it would be interesting to see his lawyers say, "People bought GTAV because of his two songs!"



 

Really not sure I see any point of Consol over PC's since Kinect, Wii and other alternative ways to play have been abandoned.

If somebody says they don't want their intellectual property in the game, it doesn't go in the game.  Full stop.  

It actually matters tremendously, albeit for practical rather than legal reasons. If these claims were raised by some no-name musician without a penny to his name, his leverage would be greatly weakened: legal proceedings are expensive, IP litigation doubly so, and fighting a successful and wealthy corporation compounds the probelm even more. Because this guy apparently has money to fight, the legal calculus starts to shift dramatically in his favor: he can't simply be bullied away, or bought off for pennies.

Eh, the Dog Pound album went number 1 on the billboard 200 and he's had at least one more if not more forays in the billboard top 10.
