"The concept of "used games" doesn't exist"

This part of the thread title doesn't make sense. Also, you could've used more appropriate example than "jacket". There is indeed a difference between software and everything else. Could I just start selling my copy of Windows 7 (not that I have such a ghastly thing) as soon as I move on to Windows 8? No, of course not.

I think the whole situation is fine as it is. I've been able to buy more games (of better variety and quality) than I ever could in the previous generations of consoles. Games cost a shit ton to develop, yet they have remained at pretty much the same price since 1997 (when I got a PS1).

I think we're too fond of complaining. AND, if you really h_a_t_e this licensing stuff, then just get a PS4 instead of an Xbone. Or a pc. Or Wii U.

Or whatever.

There's more choice than ever (at better prices), yet we still find the need to freak out and launch internet campaigns. Just don't buy that shit then.

I repeat, your thread title doesn't really make sense.

I'm sorry, but the way that OP was written almost broke me. It was hard to follow, and I'm not exactly sure what your overall point was, up until the slightly-related conclusion at the end.

Used games DO exist. Have for decades. It's when someone who bought and owned something brand new, sells that game or system or controller now to someone else to own. Whether it's at a pawn shop, or a yard sale, or a flea market, or just from friend to friend. So I'm not sure about the title of the thread, even.

And also, since when is there a law against modifying PCs? People do it all the time. And what about people who build their own modified models from the ground up? Not quite sure what that meant either.

I agree that game companies should not be allowed to have any say in someone selling or buying pre-owned games. I can see, in the case of some SMALLER developers/publishers, how they might lose money/sales figures on people buying used copies instead of new. But for most of the big fish, their games tend to sell well enough that used games sales are a drop in the bucket. So I agree with that notion completely. I just think the OP could/should have had a more structured and coherent point.

Your delivery (sentence structure) could use some work, but I agree completely. If I buy something (clothes, car, movies, games, etc.), I have the right to do whatever I want with it. Publishers are trying to stop this with games because they have terrible business models and poor project management. That's the real reason devs and publishers go out of business, not because consumers are trading and selling their games.

You don't own any game, if you "buy" it you own the physical media and a license to use it. The game it's self is covered by copyright law, which is a complex quagmire and your rights vary wildly depending on where you live.

Sure, you own a license to play that game.  Keyword being that you OWN that license, and it is your right to do with it as you please provided you don't make illegal copies.  It is your license, and you can sell it, lend it, give it away, whatever you want, and it's none of EA or Activision's business.

That's not exactly true.

If there is a contractual agreement, which one could argue the EULA is, than thee is the argument that you would be bound by the terms of that contract.

LOL PC market is more than solid but either way not trying to say it would influence the console market or anything just saying it went through all of this...

Let me stop you here. The PC market went through death.

Outside mmos -in the general sense- almost nothing big is really developed with the PC in mind. Realistically the PC market is nothing more that the bargain bin for console ports. It could do numbers once in a blue moon but it is not dependable, thusly it cannot sway the will of the publishers. It's not Batman.

You don't play games on PC clearly, that's fine. Not going to bother letting you know why you're wrong as far as big PC games, it would be a waste of time. But still, it went through the same thing the console market is about to go through and came out fine. lol @ death. lol @ swaying the will of publishers. You're still not getting it. Oh well, toodles.

The poll might not give the most correct options but this is what happens:

You buy a copy, you own that copy and that copy should not stop working if you decide to give it or sell it to someone else.
The copy cant be selective of when it wants to work and the original seller has no right or claim over that copy they themselves sold. Its still beyond me how the arrogance and greed leads them to think they can legally sell the same disc multiple times. Cmon...

Only 6 people in the poll disagree with the OP as well, not surprising

There are 130 who have responped and seem to understand that title/thread.

You are obviously hypocritcal either because you are a CM or a EA/Xbobe fan. Anyway you are the type of people that I mention, who would buy and protect anything the media, the gov or any other system tells you.

Guess what? Yes you can sell Windows 7 if you don't use it, the same you can buy an iPod or Blu-ray (talking about electronic and software in physical format).

No it's not true that games cost a ton to developp and again, how is it our problem ? Again unless you are lying and you have stake in Microsoft, why would you be concerned with cost/profit as a consumer? Do you do this for oil and General Motors? For food and Monsanto? Did you defend EA in the Sim City debacle? Probably...
