The policy is only COMG I believe. And I really highly, highly, highly doubt it would be any different with the policy gone. The Switch is a new console, unless you buy a game with it it's just a brick. 1, 2 Switch can be kinda sorta discounted maybe, but Zelda? The numbers would be probably identical or very close to it.

Why would anyone buy a new console without a game to play on? Zelda would get bought regardless of being "forced" to get a game. It's not like there are a shit ton of games available at launch.

If they don't like Zelda or 1 2 Switch, wouldn't they pre order somewhere else that doesn't have this policy? Maybe people who pre ordered the Switch were also planning to buy 1 of the 2 games?

It exists a scenario where they don't get points: Switch pre-orders being sold out. Since Zelda and 1-2-Switch are still increasing, that means that Comg is still accepting hardware pre-orders.
That said, it's true that some retailers opened pre-orders again last week, but they're sold out and closed it again. It's surprising that Comg is still accepting pre-orders. That could mean two things:
1. Nintendo's Switch shipment is bigger than anticipated
2. Comg is accepting more pre-orders than they can hold.
Giving Comg's curriculum, I'm going with option 2. I wouldn't be surprised if we see negative points, or if at launch, pre-orders numbers are higher than weekly numbers. I mean, it's not te first time it happened.
Personally I doubt Switch first shipment will be higher than 350k.

In Japan's case that is true. But in all honesty that decline IMO ironically started in the 7th generation when it looked the strongest. They built up massive IP-s on handhelds, for them to find no real base on home consoles, once the handheld market retracted. I mean nothing really compared to the selling power of the DS and later on the DS and PSP combo. But than the 8th gen came, and as good as the 3DS stood the ground (still had a fairly large decline ) the Vita never took off. Massive franchises like Monster Hunter, Professor Layton, Inazuma 11, etc. will never make the jump to home console big players, if massive modifications are not brought to the tried and tested formula :(
