I guess that is because it is the same PS2 version but with emulation software done by Sony. But it is not a new version. If nintendo did not had any implication regarding if the series releases in certain consoles, FF4 would have been released for the PS3 and 360 too.

Maybe the contract implied that nintendo share is only for future installments of the franchise. And considering that an HD collection has another name, it can be considered a new installment; at least I think that.
