Nintendo is good with customer service, taking into account their low rate of failure/factory defects.
I was actually surprised to get my first defective Nintendo hardware when I paid $250 for the 3DS on release day though. The funny thing was I didn't catch it until almost a month of use. I just remembered thinking "why is the volume on the 3DS so low?" and "the DSl has louder speakers and better sound quality." Eventually I figured out the right speaker was dead, as in no stereo output and about 50% volume which explained both the low volume and poor sound quality.
I think it took about a month to get it fixed, maybe a little less. Painless process.
And then one of the little rubber feet fell off at some point; I assume it's in the vacuum cleaner bag.
And the 3DS hinge wobbles a fair amount more than the DSl, but that was less of an annoyance than an "oh yeah, the hinge is pretty wobbly" type of observation.
