Am I still okay with cassette tapes that I recorded off records or will the RIAA come and get me too? I may have to take this to the Supreme Court!

What if you buy a CD on 1st day of release, copy it, then re-sell it on ebay same day. Apparently it is also illegal to sell an MP3 player with MP3s on even if you legally bought them. http://www.reghardware.co.uk/2006/02/13/riaa_ipod_warning/ A few months ago on BBC news was an article about a guy that was selling every UK number 1 ever made, from old vinyl to mp3s he had paid for on his ipod. A big auction house was selling his collection and it was expected to fetch several thousand pounds. Just to be awkward I decided to email the auction house and the BPI (The BPI represents the UK recorded music industry) to inform them that their auction was illegal because of the ipod with mp3s / that an illegal auction was taking place. http://news.bbc.co.uk/player/nol/newsid_5220000/newsid_5224600/5224646.stm? Neither side emailed me back but the auction still went ahead...wonder why!!

People do that all the time. I don't see them getting sued.

 People do a lot of things all the time. The fact that you don't see them getting sued doesn't mean its legal. 

This is actually an interesting case, because its probably legal but it really shouldn't be. That said, with 'fair use' scale is very important. Its perfectly legal to make a copy of a disc you own and give it to someone. Its not legal to make 10,000 copies and give them to everyone in the city.

Similiarly, it would no doubt be ruled legal to do this for the odd CD, but if you bought, copied, and sold hundreds of CD's a week it would almost surely be ruled illegal if you were charged.

Its not just the activity: Scale also matters.

In a different case, Sony BMG's chief of litigation, Jennifer Pariser, said. that "when an individual makes a copy of a song for himself, I suppose we can say he stole a song." Copying a song you bought is "a nice way of saying 'steals just one copy,' " she adds.

 

Sounds like she really knows what she's talking about

 



This sounds very disturbing. Fortunately my country has so far only prosecuted people for sending stuff (admins of torrent sites etc) and not downloading, but there's no telling what will happen if the States keep giving an example like this.

Please elect someone who isn't a completely idiot later this year.



Is ripping DVDs illegal too, because I have quite a few seasons of TV shows which I put on my iPod or PSP?
Apparently in the iTunes guide to ripping DVDs it says that it is for use with CDs which have your own content that you recorded yourself on it
