People do a lot of things all the time. The fact that you don't see them getting sued doesn't mean its legal.
This is actually an interesting case, because its probably legal but it really shouldn't be. That said, with 'fair use' scale is very important. Its perfectly legal to make a copy of a disc you own and give it to someone. Its not legal to make 10,000 copies and give them to everyone in the city.
Similiarly, it would no doubt be ruled legal to do this for the odd CD, but if you bought, copied, and sold hundreds of CD's a week it would almost surely be ruled illegal if you were charged.
Its not just the activity: Scale also matters.
