Forums - Sony Discussion - Jaffe thinks Sony should sue Microsoft over Scrap Metal!

I don't buy the God of War one, but this "Scrap Metal" game is obviously a rip-off of Twisted Metal in more ways than just the title. I don't know if it's sue worthy (I doubt it) but it's pretty sad to see.

Naming 2 things completely different the same name (like the comic someone showed) is different than naming something very comparable the same name. Someone knows the story of war of the gods? It maybe why he said they should sue, I mean if its the same story than god of war. For Scrap Metal tho, its pretty obvious what the developer are trying to do here, if it would be my trademark I would certainly sue them. Not for money but to force them changing the name. Imagine if 3D dot game heroes would get call, Dezla a link to the ancient time.

Naming it twisted metal would make it the same name. Sharing one word out of two is perfectly fine.

Essentially what Sony would have to do is prove the durr test. Essentially they bring you up in court and then they show you the picture of the name Scrap Metal and then ask you about what you think you're seeing. Can you honestly imagine anyone failing the durr tes here?

Like me and others said It actually share 2 words not one. Metal is the same, scrap and twisted are synonym, each of the titles means the  exact same thing: deform metal.

It doesn't matter, they have to prove confusion. It doesn't matter if they are similar, all that counts is that the average person would be confused by the conflicting trademarks.

Scrap metal = Waste metal

Twisted metal = litterally twisted metal. But twisted does not make it scrap.

Anyone who gets confused between the two is seriously lacking in the mental department. Are you confused between the two.

Words have different meanings. Twisted (metal) can be used as a synonym of scrap (metal) if it's used in the proper context, and vice-versa.

Uh... Im a welder and I fail to see your logic, if metal is twisted 99.9% of the time its fucking scrap, you cant build shit out of twisted metal because it wont be square or level.

Christ sake what are you trying out for microsofts legal team or something?

I guess Tecmo best get to suing Jaffe over the similarities between Rygar and God of War. (I'm sure Jaffe won't mind what with such a broad interpretation of copyright law.)

Jaffe is right about his opinion not making other people geniuses....

The other part though... i'm not so sure... since War of the Gods is a name that predates god of war... if Sony could sue them.... sony could in turn be sued.

Wire cables are twisted metal and you build stuff with that. Remind me why it isn't good enough to hold up your elevator?

In any case they have to prove that the game name confuses people. Now as far as I can see everyone here is having a bitch and a moan but noone has ever been confused over this, there haven't been threads asking if Twisted Metal is coming on the Xbox 360, the target market is safe from retardedness, at least to this level, so why the grief?

Because some people feel the need to defend Jaffe no matter how stupid he's being?  I don't know... it's silly.

And its not a microsoft game, despite what people keep saying.

When a metal is twisted, dont you think it is scrap? I for one think its scrap and will either trash it or repair it. You need to place things in context, in this case either scrap or twisted means the same thing, a car metal being destruct.

You still haven't answered me.

If

1. It confuses people they have a case.

2. It doesn't confuse people then you're just blowing smoke.

Does it confuse people?
