Naming 2 things completely different the same name (like the comic someone showed) is different than naming something very comparable the same name. Someone knows the story of war of the gods? Naming it twisted metal would make it the same name. Sharing one word out of two is perfectly fine.

Essentially what Sony would have to do is prove the durr test. Essentially they bring you up in court and then they show you the picture of the name Scrap Metal and then ask you about what you think you're seeing. Can you honestly imagine anyone failing the durr tes here?

 


Like me and others said It actually share 2 words not one. Metal is the same, scrap and twisted are synonym, each of the titles means the  exact same thing: deform metal.

It doesn't matter, they have to prove confusion. It doesn't matter if they are similar, all that counts is that the average person would be confused by the conflicting trademarks.

Scrap metal = Waste metal

Twisted metal = litterally twisted metal. But twisted does not make it scrap.

Anyone who gets confused between the two is seriously lacking in the mental department. Are you confused between the two.

 

 

Uh... Im a welder and I fail to see your logic, if metal is twisted 99.9% of the time its fucking scrap, you cant build shit out of twisted metal because it wont be square or level.
