It seems to be pretty widely reported: https://www.gamingbible.com/news/hogwarts-legacy-2-fans-concerned-870065-20250502 https://kotaku.com/switch-2-upgrade-pack-hogwarts-legacy-civ-7-1851780505 https://mynintendonews.com/2025/05/13/hogwarts-legacy-nintendo-switch-2-upgrade-will-cost-10/ |
This is how it was last month, it's a main reason why I didn't buy it during it's EU sale on Switch 1.

| Avalanche Studios has confirmed that Hogwarts Legacy on Nintendo Switch 2 is a new build of the game with "next-generation assets" instead of using the Switch port as a foundation for development. However, this means there isn't a Switch 2 Edition upgrade pathway for players who already own the RPG on Switch, like there is with The Legend of Zelda: Breath of the Wild and Super Mario Party Jamboree. |
Just googling on this I have found this other article: https://www.videogameschronicle.com/news/hogwarts-legacy-on-switch-2-appears-to-have-a-10-upgrade-for-owners-of-the-digital-switch-version/

So that could be proof, as it comes from the eShop itself.
A little more googling has also shown that Civ 7 is going to do this as well.
