That sort of thing is always a bit hard to measure. Not only are markets different now than they were in the mid 2000's, what with digital retail games, the shrinking Japanese market, mobile devices, etc, but the DS and 3DS launched at different times of the year. Therefore, sometimes the DS is ahead simply because it launched right before the holidays and the 3DS launched soon after them, while the 3DS has ocassionally gotten ahead thanks to its various special circumstances, including a bigger holiday 2011 than the DS had in 2004.
The 3DS is about 2 or 3 million units behind where the DS was at this point in its life, in early 2007. However, the 3DS is likely to close thaat gap over the next three months, because its only now having its third holiday season, is getting its first Pokemon generation later than the DS did, and has more games coming out in late 2013 than the DS did in Spring 2007.
So, in short, the 3DS is slightly behind the DS in Japan for this part of its life. But mostly because the DS Lite was a beast in 2006.
One more thing: the DS actually slowed down in 2007. The 3DS is likely to do something similar, but the late releases of 2013's biggest hits will likely give it extra life, along with major 2014 titles such as Super Smash Bros, Kirby 3DS, Yoshi's New Island, etc.
