Forums - Gaming Discussion - GameStop Sued Over Deceptive Used Game Sales

Free advertised downloadable content an issue for used market.

March 25, 2010 - A lawsuit filed earlier this week against retailer GameStop says the company is "deceptively misleading" its customers into believing a used game purchased from the store comes with all packaged downloadable content advertised on the box. This content, however, is only made available for free to those who purchase the game new, as the code to access the content can be only used one time. 


This problem arose in January when plaintiff James Collins purchased a used copy of Dragon Age: Origins from a GameStop store in Hayward, California. Collins paid $54.99 plus tax for the game, $5 less than a brand new copy. 

Collins states he purchased the game in part because of the box cover, which advertised that additional character and quest content could be downloaded for free upon purchasing the game. Collins discovered weeks later, however, he would have to pay an additional $15 to access the content, ultimately paying $10 more to purchase a used game with less content. 

When Collins tried to return the game for a refund, the GameStop manager at the store said he could not because the seven-day return window had passed. 

"GameStop, who makes more than 20% of its revenue and nearly $2 billion from the sale of used video games, is aware of this issue, and continues to fail to alert customers that this content is not available on used games," the suit states. "As a result, GameStop tricks consumers into paying more for a used game than they would if they purchased the same game from content new." 

Collins is seeking restitution, punitive damages for fraud, and interest from the sale of used games that were wrongfully obtained.

Well he is an idiot for not knowing that in the first place and i hate gamestop so they should be sued.



So he couldnt just buy it new for 5 bucks more? However, gamestop needs to cut that crap out.



The most surprising thing about this is Gamestop only makes about 20% of its revenue from used games. They can definitely survive without whoring used games like they do. But digital downloads is their biggest problem.

I wouldn't call him an idiot. I mean yes me and you would know that used copies don't contain DLC codes, but an average person would believe what the cover had to say, used or brand new.

What an idiot... Some people make such a big deal about things like this. He just wants a piece of gamestop's pie.



I mostly play RTS and Moba style games now adays as well as ALOT of benchmarking. I do play other games however such as the witcher 3 and Crysis 3, and recently Ashes of the Singularity. I love gaming on the cutting edge and refuse to accept any compromises. Proud member of the Glorious PC Gaming Master Race. Long Live SHIO!!!!

Plus what if they are out of new copies? Go to another store and waste gas? Or buy used.

 

 



OH this isn't going to go anywhere because I'm almost positive that anything that comes with things that you only get when purchased new, has something where it states "only available with full retail purchase". And then it'll tell how long the validity of the code or offer lasts.

Meaning either the company or Gamestop already has that covered (especially if it is a Gamestop preorder bonus that comes inside the box). But the dude didn't even bother to read the fine print.

I work for Gamestop, and I know they rip people off or screw them all the time, but this is not one of those cases.

You know what, I just checked my preordered and bought copy of Dragon Age: Origin and it states:

"One time use code available with full retail purchase"

Frivolous lawsuit confirmed.
