Wouldn't know... I only saw the trailer and that scarred me, mentally, so much there was no way I'd even consider watching the whole thing.

I didn't know they planned to profit from it. Do they think Nintendo would ever let anyone get away with that illegally?

I mean, if it's a fan production without any intention of profit, then more power to them. But if they planned on dvd and theatrical releases... Then they're making profit off of someone else's idea. As a big fan of Zelda, I wouldn't want someone to profit from the franchise illegally,the producers can spin that bull about expanding the Zelda universe all they want. If it was just a fan movie, then fine, but I think Nintendo are well within their rights here, they need to protect an IP as cherished as Zelda.

It's not a "fan film" when the fans try to make money off the project. It becomes a "film" that has stolen IP from someone else. This is an easy case. The producers of the film are in a no win situation here and they purposely put themselves into it. Also, if you run a website and plan to be an exclusive streaming site for a film that has legal issues and the company who owns the IP asks you to stop streaming it. You stop streaming the movie. If you don't stop streaming the movie and you have ads on your site to make money you can easily be sued and lose as it's a revenue generating model.

Dailymotion has a similar business model to TV networks. Both sell advertising spots based on "views". If a TV network did the same thing as Dailymotion, nobody would run to support the station. Everybody would agree that they would need to pay the IP owner for the work they aired.

When i saw the thread title i was kinda surprised, like wow, Nintendo actually sued these guys? ... why? it is just a tribute...

But then they say that the producers were trying to profit from it??? Nintendo is not amused.

Nintendo are being tards. Period.

This is the standard behaviour for anything popular. It get's fan creations all the time. It strengthens the network. Theres also nothing wrong with being appreciated for the work you do. As long as they are not directly recieving profits from direct sales then theres no problem. So unless they are selling it and brings in positive value after print and shipping then theres no problem.

Yeesh. I always get bugged by people who think fans should be punished for showing creative effort for a creation they love. boggles the mind.



Squilliam: On Vgcharts its a commonly accepted practice to twist the bounds of plausibility in order to support your argument or agenda so I think its pretty cool that this gives me the precedent to say whatever I damn well please.
