Ummm neither PSN or xbox live auto ban for controller mods, try doing some research yourself before you go questioning facts.

I've seen people doing similar glitches on XBL, especially in WaW where they'll be floating around above and sniping at you.... you can take them out though, so its not that big of an issue... most times they end up being sitting ducks because you have a clear shot at them lol.

There was a glitch like this on the 360 version... 4 months ago? worked differently of course, but people were glitching through the ground and through walls and shooting People. Same glitch/Hack but couldnt/Cant fly on the 360 version.

At least 3 people are doing it per game. I was in a match with 12/12 doing it.

Wait a minute, if L1 is fly up and R1 is fly down, what's the problem? They can't aim or fire...

You could fly on the 360 version too.  There was a patch for it so I don't think people can do it again.  Hope they have that shit fix for the people getting MW2 for the 360 or PS3.
