It's a fine. You know, like a parking ticket is a fine. when the government one day just says "You broke a rule! You owe us $1,000,000,000!" it needs to take much larger legal action.

On a side note, sounds like you just dislike MS, because it sounds like a dumb rule. MS sells to retailers for whatever they want, so chances are the conversationw as something along the lines of:

Retailer: We charge $159 for the student and teacher addition

MS: We provide this to you cheaply in order to get this product in the hands of students and teachers who cannot afford packages that expensive, thus we request that retailers set the price at $129.

Retailer: Ooooh alright.

 

MS isn't going to argue with a retailer to charge more for their goods, since it doesn't effect their cut.

this doesnt sound right to me. it comes across that the retailer was selling it for inappropriately high prices and microsoft didnt like that. so for trying to help the consumer...germany wants to make a lamp out of them.

Well at least the Germans know how to target the right people. There is nothing worse that fining someone who cannot afford it!

No. The reverse is true. MS is stopping the retailer from pricing it below cost. The retailer would sell it that cheap temporarily because they could advertise it widely, causing people to come into the store and making the retailer a greater profit on other items. MS is trying to stop them because it reduces the sales of more expensive versions of Office; professional users may have chosen Home & Student instead of the full package if it was a lot cheaper.

I actually think M$ are quit a good company. But thats a different ballgame. They should be punished if they are kinda fixing prices. :)
