 Well if there is a legit infringement, even accidental, then Nintendo would be smart to settle. It's not as though the DS can't print out a settlement.

I can't remember a successful product in the last decade that has not been sued. It seems like every other week Apple gets sued over something. It's just the way business is these days with the screwed up patent system. If you make a successful product, you will be sued for patent infringement.

 At leastImmersion had grounds. Former employees left for Sony, an the rumble system was on the PS1. Microsoft did pay Immersion for the rumble system when they made PC controllers, and then stopped when they made the Xbox.

No certainly not.  Frivilous lawsuits are a disease that spreads throughout the world to any company that has money.  Most of them have no basis.
