It's mainly referring to all the patents in general. Things that the competition has that the Wii U doesn't.

Clearly. Wario has invaded Nintendo HQ and is working on having his own 2D sidescroller game to launch with the NX called New Super Wario Bros. starring himself, Waluigi, and their two henchmen.

They will also patent that game and the entire side scroller genre as well.
