Nintendo do a lot of stupid things these days, though.

haha cant't deny that. game may never get released outside japan which would be damm stupid considering the wii u needs titles. but at the moment there is a somewhat logical reason as to why they might be waiting

I would certainly like to believe it is coming. Wii U does indeed need all the games it can get, especially ones like this that bring variety to its library.

They've broken into MK8, though to their credit the guys behind it apparently aren't saying how to avoid ruining the game's online:

Looks like it was a exploit in a old firmware that was patched. With the system they have now, I doubt it will be so easy to hack as the Wii. I think our best shot will be a western localization.

Where there's a will, there's a way; the Wii had firmware updates as well.

Obviously a Western release is preferable, but if that doesn't pan out, all hope is not lost.

Hopefully we won't have to rely on someone to crack the Wii U to make it happen. As odd as it sounds with all of the evidence to the contrary I think Nintendo will shift their policies towards region lock in the future. But I still think a western release will happen too. But if Nintendo decides to go ultra conservative and censor all the outfits and the features of the JP version then I'd be singing a different tune.

Doesn't matter cause of Nintendo's stupid region locking policies.

That will be circumvented. Hackers have already made some inroads into Wii U, they'll crack the region lock eventually, like they did with Wii.

Excellent news! Good luck to them!

I didn't realise the Wii U had homebrew to support a fan translation.

It doesn't... yet.

Well that is very nice on their part, then. :)

What happens if right after the fan translation is finished, localization is announced? What then?

The translation of the actual text is neartly done, but its a long way from that to a workable homebrew patch.
