Forums - Nintendo - Actor hired to wear Donkey Kong costume at 2013 L.A. Zoo event files lawsuit against Nintendo

Last year, Nintendo held an event at the Los Angeles Zoo to celebrate the launch of Donkey Kong Country Returns 3D. The company went as far as to hire an actor – Parker Mills – to wear a Donkey Kong costume.

Mills has now filed a lawsuit against Nintendo, claiming that he was denied breaks and was not provided with the required ice pack to cool him down as he talked to zoo guests. The actor’s attorneys say that he suffered an aortic dissection and was forced to undergo surgery to implant a permanent heart defibrillator.

Mills’ lawsuit ultimately alleges, as reported by the LA Times, “that the company ambassador who was hired to escort him and oversee and control his activities failed to provide the proper oversight.”

Nintendo has not yet shared an official comment about the situation.

Shameful if legit. Shameful if not.

i dont understand why he is sueing nintendo, they didnt hire him direct or? it should be clear that this was not okay, and somebody has to pay for this.

Wouldn't you usually sue right after it happened?

Bet with Xander XT:

I can beat more games on his 3DS than he can on my PSVita in a month. Loser has to buy the winner a game on his/her handheld Guess who won? http://gamrconnect.vgchartz.com/thread.php?id=193531

Me!

Sigh, the Phillips patent troll lawsuit just ended and another one rises against Nintendo......

The way I see it
-Year afterwards, too little too late
-No conclusive evidence the work caused the injury
-It is not actually Nintendo that hired him, would have been a different company
-His health prior to the work will be called into question. Being an unfit and overweight individual increases risk of heart damage.

EDIT: Simply paying for the surgery is more than he should get.

Isn't California one of the few states with mandatory break laws? If he was denied breaks then he's probably got a good case--and who doesn't recognize that someone wearing a hot costume while outside needs the chance to cool down? That's kind of awful.

I don't know about the medical stuff, however. Specialists will have to determine if his condition was caused or exacerbated by the events at the zoo.

As far as the timing, that's usually decided by lawyers. They will often wait to build a case before filing.

Shouldn't be hard to prove that he had a real heart surgery and the causes.
