They should be forced to refund everyone that expected AAA exclusives...

whats the last AAA Vita game you bought? :)

I wonder if the PS division will announce a loss because of this?

C'mon, they over-promised with Kinect and didn't deliver and they're doing the same with Kinect 2.

And please don't put words in my mouth, point out the part that I said Vita did nothing wrong........

I've seen plenty of gaming companies (hardware and software) not give us what they promised over the years. Maybe pointing out something on a MS console was a bad idea but Kinect it the most obvious recent one to not give us what they promised. I just found it strange and inconsistent to pull up the PSV while a lot of others go unpunished.

If it's the start of a crackdown on gaming companies then I welcome it.

and still you refuse to differentiate between an ad and a reveal of a concept... fine.  I'll leave it at that.

Again I'm not sure why you bolded that statement and made that comment. They don't correlate to each other. If you want to address my statement then stop focusing on one thing. My statement still stands, they over-promised and released a product that under-delivered. But yeah, I put that concept video up because that was the beginning of overpromising  that spread through MS reps and gaming events until it released and people realised that Kinect isn't what it was cracked up to be. Concept videos should represent the product and for me they misrepresented Kinect in their favor. They are doing the same with Kinect 2 but it still struggles getting basic voice commands right.  How many people bought the Kinect and were pleased with what they got? I know 4 people from my experience who feel they didn't get the product that they thought they were getting. Of course everybody's experience is different but from mine and what I've read, Kinect didn't deliver.

Anyway I didn't want to focus on MS because there are more examples. I can name examples where Sony showcased games to sell systems that didn't see the light of day. I can bring up countless times where we were showed bullshots to promote a game. It doesn't matter if it's a ad, pr quote or gaming event, it's all directed at the public.

I thought this was a bumped thread from 2012 :/ Pity this doesn't apply to the EU..

We get the difference. On ad you overhype a product and on reveal of concept you show what you will deliver.

Have forza allowed people to simulate a pit stop as show in the TV ad or scan your skate and play with it in any skating game or use a rl pistol to play cod?

one forms a potential contract with a buyer and one doesnt.

its basic legal principles and why they have been fined.

its very, very, very simple.

I see, Sony ad is a form of contract but ms ad aint? Seems coherent.

But I go back to the lying portion, since no one is complaining of Sony being sued. But you claimed they deserve it because they lied to sell a product, but for MS you invent apologies, ok then. I don't think discussing this further with you will add anything.

I got mine at launch. I want my $50!

This is for US?

Can't find somewheres to apply for it though.

Same here. I'm not even sure if I have the reciept either.

How am I going to prove I bought it at launch?

Model, serial number or psn registration all could help you to prove it since no buyer is obligated to keep receipt of all the things they buy.

But there is a difference between a press conference/interview and an advertisement. If there is an advertisement where MS lied then they can be sued just like all other corporations.

If someone is talking about their product they made and telling others what the future looks like then its fine if some things are missing or aren't followed through on. But when an advertisement is televised or marketed to people displaying the capabilities but don't actually exist or aren't followed through with then that company is going to get sued.

I'm pretty sure this was advertised, at least in Brazil it even got to television.

Also bullshot and fake footage in TV is the same... but I get it, MS never done it even if evidence contradicts it.

In that commercial at the bottom it clearly states actual features and functionality may vary. The commercial then stated there's a new way to play and that you are the controller; all true.  It shows a kid fighting in front of a screen and another racing using just her bare hands, both you can do on kinect. Then it states you can use your whole body; also true. Then it states it tracks full body motion; again, true. It then states that you can use your own gear; kinect IS capable of doing this but not sure how many games (if any) take advantage of it, but still, nothing illegal here since the feature exists. Facial recognition exists, connecting and sharing exists, voice recognition exists, controller free entertainment also exists.

I don't get the point of the video...?

Sony did something different. They advertised specific features that never came to fruition or just simply didn't exist. Microsoft deals with ALOT more lawsuits than Sony does so its not like MS isn't targeted. If MS did the same thing Sony did then MS would get sued just like Sony did.

"Sony also failed to mention that you needed to buy both the PS3 and Vita versions to use this feature."

This has to be satire.

I'll sue Sony because they show all those games on ads and don't say i need to buy to play.

Damn! Sony IS in trouble.

Yes, they are. They'll have to give me all games free of charge. Will also sue all other that do ad without msrp and don't say I have to pay for it to have.

And is there any game that is a direct port that have crosssave/play available?

Damn SONY are very responsible for their product unlike their competitor.
