Stuff like this hurt relations amongst business partners. Acti spent weeks and months working out an exclusive ad deal with PlayStation only to have Xbox come along and ridicule it. Doing stuff like that hurt relations. No one at Activision is looking at this and saying "how funny, how clever."
You have to respect contractural obligations if you want to remain in good standing with other business you relay on to deliver content.
The game is not even out yet and MS is already, selfishly, dragging the IP name through the console war mud, an image Bungie and Activision have been trying to avoid since the game was announced. The folks that work out these deal are business professional, they are not fan boys or kids on the net, they care not about the console warz, it's not appropriate to ridicule their work.
And this is from a pub that took good care of Xbox last gen, to Acti it might be a slap to the face.

Oh, they certainly care.  Not necessarily as it pertains to Destiny but rather to the nature of exclusive contracts.

Let's say that part of your business model is to sell exclusive advertising contracts to various vendors.  If a loophole is found that circumvents the very nature of those agreements, why would anyone pay for them in the future?  If nothing is done, the client being wronged would be angry and would undoubtedly turn to similar tactics in the future.  You would lose a revenue stream as well as the appearance that you are in control of your own intellectual property.  



This is actually quite clever. x3 Sets a sticky precedent, in a way, as they've opened themselves to have this done to them without legal recourse, but the thing is, all Microsoft is really doing is putting a page on their site- which they are allowed to do- that details how they also have this multiplatform title. No advertising deals don't include, to my knowledge, a restriction on saying 'We Have This Game' on your OWN site, they just keep you from slapping your logo on banner ads, commercials etc for the game elsewhere.

The whole 'we're making it a perfume ad to duck under the no-advertising law, lawllawl' is a smokescreen. What they're really doing is using what they CAN do- say on their own website, 'yes, yes, you can also play Destiny on an Xbox One'- but in such a way, the media is more likely to turn it into a big fanfare of a thing, which will draw more eyeballs to their website, and let them aggressively advertise that they have Destiny without actually aggressively advertising it. All the 'user coaxing' will be done not by paid campaign ads, which would violate the agreement, but by the media sources reporting on that page.

So kudos to them. ^_^ So long as they don't turn Full Legal Dick if ever Sony does the same thing with Evolve or Call of Duty, of course, (i.e. making a page or reference that you HAVE the game on your own site, but making it interesting or funny enough to draw media and consumer attention,) as then they'd be tromping firmly on hypocritical grounds. =P

 

EDIT: Just realized the link is down, so looks like it wasn't clever enough. xP Probably gave them enough of a spotlight to appease them, though, especially if there's no legal consequence from this.

I doubt that. Most of Sony's ads are for 1st party games. I haven't seen many PS3-specific ads for 3rd party games aside from Assassin's Creed and Madden. My point? Sony pushes 1st party games in TV ads. Microsoft pushes 3rd party games.

The abscence of CoD and *insert 3rd party game here* from Sony's marketing budget doesn't mean M$ paid the publisher off.

This is fantastic! Sony must be hugging themselves in disbelief at the moment. How the hell do you manage to get yourself a bad name and then make it even worse? It's funny because XB1 fans are all defending it and arguing it's not desperate or it won't damage anyones reputation while at the same time the reality is playing out all over the internet. This thing will be brought up time and time again. This is much worse than their TR mess.

And worse than the XB1M13 agreement MS and Machinima tried to pull at the beginning of this year.
