Well they are so right to blame the stupid law. The law must be targeting spam specifically and not all email.
We have a user base of 100k users with my indie game and what we are thinking is exactly that, stop sending anything and then ask them in-game or on our website to subscribe again (which is ridiculous) as we cannot really know if the user lives in Canada or not.
Microsoft does not want to take any risk and open themselves to stupid people who will sue them the day they will receive one single email from them even if it is not spam but something like a security issue or anything important.
Meanwhile, here in free OS country, I have no need for antivirus software since there aren't any.

I can personally vouch that their security emails were like spam........so frequent.

Seems like some people failed to read the article. MS sending security bulletins and advisories is specifically covered by exemptions. No doubt there are flaws in the law, it is government trying to regulate the information superhighway after all, but I don't think this particular situation is exposing one of the flaws in the law.
OTOH the exemptions that allow MS to continue to send out security alerts don't help the indie game developer as there's not likely to be a warranty, safety, recall or security issue arising with an indie game, or if there is clearly the indie game is actually malware.
