Seems like some people failed to read the article. MS sending security bulletins and advisories is specifically covered by exemptions. No doubt there are flaws in the law, it is government trying to regulate the information superhighway after all, but I don't think this particular situation is exposing one of the flaws in the law.
OTOH the exemptions that allow MS to continue to send out security alerts don't help the indie game developer as there's not likely to be a warranty, safety, recall or security issue arising with an indie game, or if there is clearly the indie game is actually malware.
