called nintendo customer service to ask about unlink my NNID from old one to this one and they said the games will stay :D. When i bought it, it was on old fareware (before Nintendo connected Eshops) so there was NO Nintendo Network ID linked to it!

I bought my 3ds xl for 150$ from a man on craigslist had firemblem awakening on it and also Luigis mansion also with a bunch of old nes games.
too bad I hate Luigis Mansion and Fire Emblem :(
