Emulators are legal like bootleg consoles are legal.  They're engineered to play games on whatever system, but they're not being sold as Nintendo consoles, just as devices that can play Nintendo games. 

Roms on the other hand are illegal.  The whole as long as you delete them within 24 hours is bs.  They're illegal, but since the games are decades old and most don't make anything or much from them at all, it's not worth the legal fees to go after people who download them.

Nintendo is the one company who still tracks and enforces it though, as a friend of mine had to reinstate the internet of a person who got a DMCA violation for torrenting Super Mario Bros or a zip with all the Mario games or something like that.

This is absolutely right. They're illegal whether you own the game or not, whether you delete them immediately or not. They're illegal, period.

Well that's retarded, yet another failure of the legal system. 

ROMs can be legal. According to the law, you are allowed to own a backup copy of a game as long as you own it (beating the purpose of a backup copy, since you have to delete the backup when you lose the game). However, you have to do the backup yourself (dumping the ROM), and you're not allowed to share it. That's why all ROMs on the internet are illegal: they're shared. Owning the game doesn't change that.

I have a hard time seeing the emulator itself beeing the problem, but will X1 allow you to store any file on an external drive? If that would become the case, it will be the greatest console of all time for me :).



Yes, as I work for MS I can let you know that it is possible. There are no restrictions from MS side that would not allow the app to be published on the X1(Store). And the only reason for it to be removed would be complains from consumers or corporations(Nintendo or others) because of copyright protection.
