That's kind of unfair to use against the LoTR franchise though, seeing as how it more or less created the bedrock for the modern hero journey archetype. It was the prototype of all modern, similar writings, it's kind of like blaming Coca Cola for Pepsi's bland taste.
I get what you're saying though, and I agree in principal but if any game or story set in the LoTR universe deviates heavily from the known norm, all, or at least most, association to the franchise will be lost and they might as well use another universe or even create another one. Personally, the incredible richness and detail of the LoTR universe makes me forget the somewhat tired hero journey formula.

I know it is unfair, but I still really much dislike it, but from the looks of it, this seems more darker and deals with the good part of Lord of The Rings that I do like.

It's funny when people can't recognize a bad game.
Everything ripped off straight from AC and made by a small studio (as if AC has good gameplay. I love AC but the gameplay is mostly a joke).
They even ripped off the meaningless Eagle eye mechanism from Assassin's Creen and worthless combat.
Intelligent enemies, yeah right.
