How about a sliding phone? Much like phones which have a physical keyboard. Instead of the keyboard yo uhave the bottom screen and the controller buttons. When people want to text, that extra screen can act as a virtual keyboard. I was also thinking of something that doubles with the android operating system, much like how the backwards compatibility works with the wii u. When you switch to the wii, it changes over to a different mode.
I was thinking that, along with them porting their older games over to android and iphone. Make agreements with companies that make third party controllers so your're games can be played as intended.

Same reason people would buy a 3DS; it has Nintendo games and the price is relatively low (if they do this it would be perfect thing to buy as a kids' first smartphone as wel). If Nintendo manages to couple this with some basic functionalities like multitasking and multimedia than it would be a win as an entry level smartpone. Of course if Nintendo decides to price it at like $500 then of course the device will fail. Moreover, I think Nintendo would wise to release a portable non-phone version as well for those who do not want the phone functionality.

and as if all ninty needs these days is more hardware to try to sale.

Well they might as well try, Nintendo made a lot of money from their hardware in the past. If making a single platform phone and portable fails, then they can always look at iOS and Android and other platforms.
There are only two companies on this planet making substantial profit building handsets right now, and I'm just not confident that Nintendo could be the third when former titans like Nokia and Blackberry are dropping like bowling pins.
The 3DS has enjoyed what success it has by slipping through the cracks in the smartphone market (enthusiasts who want specialized gaming interface and children who can't afford a data plan). Trying to build a Nintendophone would likely diminish differentiation and pit the company squarely against rivals it can't hope to defeat.

With all of this net neutrality coming, I foresee some restructuring in this market anyway. Plus....name one publisher who has transitioned to mobile and....has actually grown their business.
I think nintendo releasing a phone or releasing games on mobile are short sighted and bad ideas.
Or you know... they could go third party and solve all their problems.

No I don't think it will sell. I would prefer an Android or Windows device that can play 3DS games. I'd buy that any day over an Apple or Samsung phone.
