Without "illegal" roms I would've never played Seiken 3 or Tales of Phantasia on Snes!

Except that part might be important. Copyright law is not the same in every country, not even amongst European nations.
Piracy is inexcusable. Anyone trying to rationalize that it is not theft are not honest enough with themselves to accept what they really are.

People really need to stop throwing around the term "piracy" when it comes to downloading stuff off the internet. Downloading a digital copy of a videogame or a movie that has been long out of production is not the same thing as illegally cracking and / or leaking software, music, movies etc. that are current or haven't even been released yet. And nobody is making money off of the downloading of old ROM files from defunct game consoles, whereas actual pirates like those who sell bootleg DVDs or CDs on the streets are.
And a big part of the PC gaming industry is the dedication to mods / homebrew versions of both current and classic games, which is not possible without uploading and downloading the necessary ROMs and image files over the internet. Should the folks responsible for Counter Strike and Portal for example be thrown in jail for tinkering with copyrighted software and then subsequently sharing it with millions of other people for free? Or how about gamers who made fan translations of Japan-only games like Mother 3... should they be tossed into the slammer as well?
