Not sure if you're agreeing with him or not, but if your Live account is banned then you might be shit out of luck. From what I am reading, if your account is banned, you cannot access XBox Live.

People don't get banned for buying a retail game early. They get banned for playing leaked copies that need a flashed firmware. In that case they deserve it. In theory a console ban on the Xbox one will be pretty rare due to the online checks making piracy almost impossible.

A custom firmware without checks shouldn't be impossible. Or checking in a fake server.
You will need to buy another Xbone because this one will be just a big trash...

could you please talk a little more rubbish? There are still parts of this forums where you have not spread FUD yet.
MS NEVER bans people for playing games early when a retailer breaks a streetdate. I played every freaking Halo, Gears, Fable and basically every other game I preorder early. I know the retailer and we play online together. If you are playing online (early) MS checks if your copy is pirated illegally. If you did, you are banned. If your copy is legit - have fun.
They said this dozens of times.
And no, when you are banned (which is a REEEAAAALLLLYYY small part of the users) you can still connect online to check in. You can still play your games. You are just banned from the XBL Gold service, so no multiplayer and no apps for you.
Imagine not having GamePass on your console...
