Yes, it's true, and they even outsourced a great deal of Aliens' development to a third party.  Google it--really dishonourable stuff.

Usualy this is what I think of ppl making such lawsuit. But in this case, I kinda cheer for the guy, hopefully it will create a precedent so it won't happen again.

What?  Why would you wish for that.  Look closely at what they're arguing: that demos at trade shows weren't representative of the final product.  There will be no demos ever again if they win (at least not for anyone who doesn't sign a waiver first).  Part of the reason for those demos is to get a feel for how the public responds to the game, things are meant to change!  Just because people are upset over the quality of the game, doesn't mean they can SUE for showing demos.

Never put your name on something with out first triple checking the product being released. You don't get a pass for ignorance.

Yeah I agree with you as long as the demo being shown is the game being released. You wouldn't show an amazing demo then release some half ass watered down garbage of a title. Well if you do then don't charge 60$ for it.

Not everything that looks good, is good. They didn't "water down" the game to spite you, any changes they made were for a reason - in this case possibly a lack of funding or manpower. (for which you can understandably be upset) Whatever they showed, it obviously didn't work out like they wanted it to, and while you can most certainly hold that against them as a gamer, you can't hold it against them in a court of law. There's a limit to what the law can dictate, and "spare no expense to make great games" isn't something you can legislate. IF Gearbox mishandled funding for the game, then it is up to Sega, not a class-action suit, to pursue legal action. And seeing as Sega is doing nothing, I don't think Gearbox broke any contractual obligations.
