The fallout from Sega and Gearbox's dissapoining Aliens game has been ugly. Now, a class action lawsuit alleges that the companies engaged in false advertising when marketing and promoting the game.

The gaming website Polygon broke the news that a suit had been filed in a Northern District of California court. According to the Polygon report, it was filed by "Edelson LLC on behalf of plaintiff Damion Perrine." The story says that the suit "[cites] a number of California civil and business codes, [and] claims that Gearbox and Sega falsely advertised Aliens by showing demos at trade shows like PAX and E3 which didn't end up being accurate representations of the final product."

The suit claims that demos shown to the press at various events were not indicative of the game's actual gameplay. For more check out the original Polygon article.

Previously, there had been some controversy as to whether or not Gearbox misappropriated resources and money from Sega intended to be used on Aliens: Colonial Marines for other projects that were being developed within Gearbox at the time. The game was largely panned by critics, including Game Informer.

Hilarious. It wasn't long ago that Sega was canceling everything that wasn't Sonic, Aliens, or Total War because those IPs were teh futuerz. Good plan, dudes!

I can see it being successful but it shouldn't be. Think of the repercussions. Companies would be scared to show trailers (2005 KZ)

I voted yes, but with a qualification. I honestly think SEGA is not to blame at all--they gave Gearbox the money to make the game shown in the trailer, and Gearbox dishonestly siphoned much of it to put toward Borderlands 2. I know SEGA is legally at fault, since they are the publisher, but it really was mostly Gearbox that deserves this.

Remember when Sega used to be awesome? Back when they were the only ones with Blast Processing!

Most trailers have a warning that says "not representative of actual gameplay". 

Is that true?  That they used money intended for Aliens to fund Borderlands 2?  If so I just lost a huge amount of respect for Gearbox

Most demos also have "work in progress" too. Which implies everything might change.

gearbox is the one to blame if what has been said is true.
