Cloud gaming firm Gaikai has been issued lawsuit papers which allege the company "has committed and continues to commit acts of infringement".

The complaint was filed on October 5th by the relatively unknown communications technology firm T5 Labs.

It was generally considered a matter of time before T5 Labs launched a legal complaint. In February, the company alleged that it had secured a cloud gaming patent that pre-dated that of rival gaming firm, OnLive.

OnLive has since buckled under its own debts while Gaikai was bought by Sony in a deal worth $380 million.

T5 Labs has not explained why it has shifted its focus from OnLive and to Gaikai.

The company alleges that Gaikai is infringing on certain cloud technology patents.

The shift of focus probably happened like this: "Man.. those OnLive guys are falling apart. Hey, wait, Gaikai just got bought by a huge corporation and they're thriving? ATTAAAAAAACK!"

I hope this lawsuit doesn't go anywhere. Last thing Sony needs is more financial troubles.



Patent law is getting ridiculous. It's going to end up strangling growth. Everyone is afraid to do anything new because there *might* already be a patent. Kind of like the roadblocks HTML5 has had to deal with.



If your patent has been infringed, and you are about to enter into a patent infringement lawsuit, you need to know that you are entering into a very risky venture. In addition to being expensive, it is a process that can take years. And you could still go to trial and lose! One good example is William Faulkner's Case. Faulkner Literary Rights LLC, literary rights owner to William Faulkner’s work, has filed two copyright infringement lawsuits over alleged illegally-used quotes.
