The key difference, i would imagine, is allowing for patches in the broadest sense of the word, that is, allowing downloadable content that is unforeseen by the software's main programming, which was impossible on Wii (those games were built with DLC in mind)

Black Ops, Conduit 2, and I'm sure the Wii version of MW3 all support patches. Nintendo themselves never took advantage of it.

How could i have forgotten about Conduit 2? I played that for a good while...

That's how it works. First you just lay down together. Then you just stick the tip in. And before you know it, you're balls deep. Nintendo has been paying attention!
It's sad to see a great developer like Ninty succumb to the disease of dlc. Th fact is 99% of all dlc is stuff that should be (and can be) included on the disc but is withheld to extort more money from the consumer. The only dlc that has ever been justified is Undead Nightmare and The Lost & The Damned/The Ballad Of Gay Tony. Shame that not even Nintendo is safe now. It's not Nintendo's fault I guess, they are a business and they need to survive. But in 10 years we'll be paying for extra side-quests in zelda, extra courses in mario kart and having to download patches to fix bugs in the latest metroid. I could tolerate the extra items in animal crossing, they are small things that add small value. This however opens the floodgates. Maybe it won't even take 10 years.
So, if you do a day one DLC on a Nintendo game it must be free?

Relax, DLC is not a disease. Yes, there are a some instances where DLC has been used wrongly, but there are plenty of cases where DLC is actually something that enhances a game after its release with content that wasn't built when the game launched. Burnout Paradise had great DLC, LittleBigPlanet 1 and 2 have seen great DLC, Mass Effect 2 had some great DLC and the list goes on.
DLC is a great thing so long as it is used right. Some companies have abused DLC from time to time, but many companies know how to create good DLC as well.
This is the right attitude to have to be honest. And whilst there are others out there who share this attitude, there are plenty of others that are the cause of any negative assertions towards DLC. Like Capcom, for example.
