To be honest though, I don't even really blame the fat kid. It's those awful parents that popped him out.

Not trying to pick an argument but what do you actually know about the attacker's parents?

Puh-lease it's always the parents.

Seriously?

There are so many more factors than just the kids parents/parenting (or lack of) that could lead to aggression like this.

People seem to be forgetting that gays are still widley hated by non gays. This type of thing isnt rare or new it happens all the time whether physically or verbally everywhere.

Any bullying needs to be acted upon quickly. There does need to be warnings though. These are all still kids after all. I would say a week would be a good first step. Then a Month, then you are just expelled. There is so much spotlight in the news and in movies on how bullying is bad, that if the kid does not get the hint by then, he or she has other problems.

No, when you harass someone and physically assault them you are not 'just a kid'. It's due to this type of mentality that nothing is really done about bullying. If you commit an illegal act, as this bully has commited, you should face harsh punishment (being expellled, and being sent to a juvenile facility seems like the minimum punishment allowable).

In today's politically correct climate full of protected minorities and perpetual victim groups... yes.

I always laugh when I see one of those celebrity anti-gay bullying videos telling the victims not to worry and that "it gets better", because for the vast majority of bullied kids out there who AREN'T homosexuals and who are bullied for all kinds of common reasons like being fat, poor, socially awkward, or just plain skrawny or easy targets, etc, often times it doesn't get much better for them throughout life.

If the video showed a kid whailing on some other random kid who wasn't gay, this story wouldn't get nearly the attention it is for the victim being gay.

The reason why you it gets such attention is because, due to anti-gay feelings which are common in that part of the world, you can't help but wonder if the bully would've gotten only a 3 day suspension if he had beaten up a non-gay kid. And believe it or not, but people actually grow out of bullying people because they wear glasses or are fat (kids can pick on anything), but people don't grow out of homophobia (or racism).

So we are just presuming that the bully would have had a more severe punishment had the victim not been gay? Yes it may seem presumable but what evidence do we actually have that this is the case?

The best way to find out if it's true or not would be to check out the school's history regarding similar issues (when the victim was not attacked for being gay).

This is appalling. Having said that this to me is no different to the thousands of cases of bullying that are occurring all the time. Children can and will bully other children for a number of different reasons and those reasons are often very minor. IMHO every case of bullying and especially when it's a physical assault as in this case should be treated equal irrespective of the sexual orientation of the victim. After all we are all equal under the law right?

All bulling are "hate crimes". I'm glad the mother is pressing charges and I hope the bully goes to juvi. But I can't stand the term "hate crime". Everyone who perpetrates violence is motivated by hate of some kind, so why do we segregate certain crimes as worse then others. If a bully beats up a nerd and gets a 3 day suspension it wouldn't make the news, but if the nerd was gay it is suddenly worse? That's what I don't understand. We should treat punish bullies harshly no matter who or why they beat them up. Their motive should only be used as evidence to convict them, not decide a sentence.

what happens in this state if you bully someone for some other reason other than sexual orientation?

Obviously you'd get more than a 3 day suspension. It was premeditated violent assault after all.

You know this for a fact?

if true then clearly this punishment is riduculous.

However, if this is in line with other bullying punishments at this school then the fact that it is gay bullying doesnt make it worse than say race bullying or bullying someone because they have a big nose.

Bullying is just as horrendous for the victim regardless of the motive.

This punishment is ridiculous regardless, considering that the bully commited a criminal offence (physical assault), and also a hate crime (he assaulted the victim for being gay). Bullying is too broad of a term as just teasing isn't illegal and it woudl be pretty hard to punish that. However, if you don't properly punish bullies when they commit actual violent criminal acts, then how do you expect to stop bullying?

I'm intruiged, what constitues a hate crime? Surely the boy could have been picked on for an infinite list of reasons but when does this become a hate crime?

A hate crime is defined is a crime when an attacker targets a victim due to his/her (percieved) memebership to a certain social group (racial, religious, sexual etc.). It generally is focused on the motive.

e.g. you beat a black person to death because he's black - hate crime

you beat a black person to death because you want his/her wallet - not a hate crime

It`s a shame to see things like this happen. I`m glad that his mother is a wonderful mother that does not fight hate with more hate and shows a great heart even when her son was the victim. It`s probably thanks to her that her son will become strong enough to understand and be above stuff like this.

From the title I assumed it was verbal so I was going to say "What happened to Freedom of speech?"
But its physical so yeah whether or not the kid was gay has nothing to do with it really. The guy would've gotten a suspension either way.

Why doesn't he fight back?
