what happens in this state if you bully someone for some other reason other than sexual orientation?

Obviously you'd get more than a 3 day suspension. It was premeditated violent assault after all.

You know this for a fact?

if true then clearly this punishment is riduculous.

However, if this is in line with other bullying punishments at this school then the fact that it is gay bullying doesnt make it worse than say race bullying or bullying someone because they have a big nose.

Bullying is just as horrendous for the victim regardless of the motive.

This punishment is ridiculous regardless, considering that the bully commited a criminal offence (physical assault), and also a hate crime (he assaulted the victim for being gay). Bullying is too broad of a term as just teasing isn't illegal and it woudl be pretty hard to punish that. However, if you don't properly punish bullies when they commit actual violent criminal acts, then how do you expect to stop bullying?

I totally agree, I would expel all bullies and make them face criminal charges.

All I am saying is that the motive, or the "reason", for the bullying is irrelevant.  It isnt any worse because it is homophobic bullying.

There are several types of bullying. Not all types are criminal activites (e.g. teasing). However it's absurd that things like physical assault go unpunished.

And bullying someone because of their race/religion/gender/sexual orientation etc. is worse than bullying someone because they're wearing glasses or because they don't like Justin Bieber.

And why would that be the case ?

Is someone who got bullied for watching wrong cartoons less of a victim that someone being bullied for being gay ?

In today's politically correct climate full of protected minorities and perpetual victim groups... yes.

I always laugh when I see one of those celebrity anti-gay bullying videos telling the victims not to worry and that "it gets better", because for the vast majority of bullied kids out there who AREN'T homosexuals and who are bullied for all kinds of common reasons like being fat, poor, socially awkward, or just plain skrawny or easy targets, etc, often times it doesn't get much better for them throughout life.

If the video showed a kid whailing on some other random kid who wasn't gay, this story wouldn't get nearly the attention it is for the victim being gay.

You know I was always wondering why no one ever used the dollar sign for $ony, but then I realized they have no money so it would be pointless.

Yes. When you bully someone for being gay/jewish/black etc. you're targetting entire communities, not individuals. This type of individual is the same kind that thought the Holocaust was a good ideea. Actually, there's no difference between that kid and a Nazi.

The reason why you it gets such attention is because, due to anti-gay feelings which are common in that part of the world, you can't help but wonder if the bully would've gotten only a 3 day suspension if he had beaten up a non-gay kid. And believe it or not, but people actually grow out of bullying people because they wear glasses or are fat (kids can pick on anything), but people don't grow out of homophobia (or racism).

I'm intruiged, what constitues a hate crime? Surely the boy could have been picked on for an infinite list of reasons but when does this become a hate crime?

To be honest though, I don't even really blame the fat kid. It's those awful parents that popped him out.

Not trying to pick an argument but what do you actually know about the attacker's parents?

So if a man goes out and kills a women becuase he hates women, as opposed to a man who kills a women because he hates how she looks, there's a difference?

Ridiculous.

The victims are hurt either way, regardless of the attackers views, motives or reasons.

So we are just presuming that the bully would have had a more severe punishment had the victim not been gay? Yes it may seem presumable but what evidence do we actually have that this is the case?

3 days? The kid should have to anger management classes.

Puh-lease it's always the parents.

and this is one reason why kids bring guns to school. i wouldn't miss the bully one bit if the boy he beat up went to his house and decided his brains should be blown out the back of his head today.

what goes around comes around and Karma is a bitch
