My guess is the shifting testimony certainly removes the whole "beyond a reasonable doubt" qualification, which is something that should be strictly observed when we're talking about the death penalty

Disregarding the fact that it is egregious that we still use the death penalty, this should have been commuted at the very least

Yet there were 34 overall witnesses and only a few shifted their stance. Then you factor in the fact that memories can be implanted, things get all the more interesting for those that shifted.

Also I don't think the death penalty is used NEARLY enough.

I do notice that no-one seems satisfied with the current situation regarding the death penalty. Pro-penalty advocates seem to wonder why these people sit around for 20 years getting a free ride from the government and wasting court time and money in appeal after appeal, and then those who oppose it just... oppose it.

Those money spent over those 20 years are, literally, money down the drain. Though there have been cases where mistakes have been made so I can't complain too much about that.

After 34 witnesses testified in his trial, 7 black jurors and 5 white jurors found him guilty and sentenced him to death. His case has been seen by over a dozen different judges and his conviction was consistently upheld. Of the witnesses who have changed their stories, the majority claim that they couldn't positively identify Troy Davis as the murderer not that they saw someone else do it; and the other 25 witnesses still claim that Troy Davis is the shooter.

While you can argue whether he should be executed or not, based on readily available information it is understandable why his conviction is being upheld; and the questioning of the conviction seems to be based on half-truths that have been spread by the media.

Can you please tell me where you got the 34 witness thing? In the article I linked it says there were only 9 witnesses.

That really sucks, but I'm with chocoloco on this one.

I wish there was a death penalty in my country. Would make a massive difference.

Crime rates in the US are still very high compared to other countries which don't have the death penalty.

Well a large amount of US crimes are non-violent (drug possession and shit like that), the death penalty has no effect on crimes like that.

Are US murder rates high compared to no death-penalty countries?

Murder rates in the US are 6 times those of Germany:

Damn the Clash were right, killers in America do work 7 days a week.

The trial was fair and so was the sentence but they should have given him a stay to look at the new evidence to see if it would change anything.

We will never know so I will not get too annoyed by this.

In more positive news, Iran released the two US hikers that were held as prisoners for two years.

Thats strange because thats exactly the reason why im annoyed.

In every case involving the death penalty, there will be no way of knowing if the verdict was indeed true. With thousands of trials going on the legal system makes many mistakes. People fall victim to many tragedies in life. So perfection can never be expected. I would rather see 200 guilty men die for their evil deeds while having one innocent man die than let murders continue to clog our prison system. If the system was refined and it took less time and less trials to finally sentance a person to death than it would be better than keeping the worst criminals alive and wasting resources.
