A man who had his sperm frozen in case he became infertile was astonished to learn that his ex-wife had tricked an IVF clinic into twice making her pregnant.

He then had to pay £100,000 towards the upbringing of the son and daughter he had known nothing about.

The father, a 57-year-old retired haulier, is now demanding a change in the law to ensure no other parents go through his torment.

The astonishing story begins in 1999 when the man was about to have drug treatment for crippling arthritis.

He stored sperm at the Bourn Hall Clinic in Cambridge to ensure that he and his wife, who married in 1979, could have a child if the treatment left him infertile.

In June 2000 the couple decided to divorce and weeks later she visited the clinic and forged his signature, allowing doctors to create embryos from his frozen sperm and her egg.

She gave birth to a girl in June 2001, claiming it was the result of a one-night stand, and a boy in September 2003. 

When the boy needed hospital treatment for a hole in the heart, his mother’s sister phoned the haulier to reveal that both children were his.

The man, who had remarried in 2002, then had to tell his new wife that he already had a family.

‘The girl had been in my house when her mother visited my dad, who was dying,’ said the haulier, who cannot be named for legal reasons. ‘I didn’t even know she was mine. My dad died not knowing he had a granddaughter.

‘When the girl got older my ex-wife texted me saying she wanted to see her father. The children asked their mum where they came from and she told them, “The freezer”.’ In 2007 the ex-wife demanded he pay an extra £100,000 after she fell into debt.

A judge ruled that a settlement he made after the divorce, in which the woman kept the family home, was unfair because it did not take the two children into account and the man was forced to pay out the cash. He says he has also spent almost £200,000 in legal fees over the years.

The man now has two daughters aged eight and seven with his second wife. He sees his other two children for two days every fortnight.

‘My new wife has been amazing about it all,’ he said. ‘She speaks to my ex-wife to do the best for the children but it has put a strain on our relationship.

‘I love the children and spend money on taking them out and buying them clothes, but it is an expense I shouldn’t really have. The cost of this has been huge.’

His ex-wife, now 51, said: ‘I don’t believe I have done anything wrong. It was getting later and later for me and I wanted to have a child. If I had not done it then I would not be blessed with my children. I have no regrets.’

And they say that it's a man's world, when women can get away with stuff like this. He shouldn't have to pay any money whatsoever, and the woman should go to jail for fraud.

Amazing current wife though, who's supportive about it. To make good of a curse is nothing easy!

The guy should be pressing charges against her, and sueing that Sperm Bank, who did a louse job of protecting his sperm. He's a real fool for having any contact with those kids, and he should resist paying a single dime to support them. This financial strain will affect his real family and children, and probably ruin his life.

Definitely a judgement call there, maybe he can see them as people who are biologically his kin, but socially not his family at all. In that perspective you're absolutely right. Maybe there is no better way to look at it. I guess I didn't see it like that. Up to now (thank God my surroundings are still sane), I've always considered blood link to be family. Still a little grey if you ask me.

The ideea is that he had no (willing) part whatsoever in the conception. It would be the equivalent of a woman getti ng raped, becoming pregnant with the rapist, and then forced to give birth and take care of her rapist's child. This woman commited fraud, and something that many women do (steal a man's sperm, become pregnant, and then sue him for child support), which quite frankly should be considered a sex crime. She should be locked up in jail, have to pay the man moral damages, the clinic should have to do the same.

As for raising the kids resulted from this transgression, the man should be the last person who should have any obligation to care for them. A relative of the woman's or the state should care for them while she's in prison, and the man shouldn't be financially burdened in any way. He has an actual family, and actual children to take care of.

A judge made a wise decision indeed in a rather complicated case connected with illegal use of sperm. A man sued his ex-girlfriend, when he found out that she had secretly used his sperm to conceive a child. The judge ruled that the woman's actions could not be viewed as criminal, because the man had given his sperm to her on a voluntary basis.

Dr. Richard Phillips sued Dr. Sharon Irons several years ago. Phillips said that his former girlfriend, Irons, deceived him by stealing his own semen that she obtained through oral sex. The woman subsequently used Phillips's sperm to get pregnant without his knowledge. The two lovers had parted by that moment, and Richard Phillips knew nothing about the baby. The ex-girlfriend also surprised her former boyfriend. Sharon Irons filed a paternity suit seeking monthly allowance for the baby. That was the moment, when Phillips learnt that he was a father. The doctor was ordered to pay $800 a month to support his child. Richard Phillips in his turn accused his former lover of "calculated, profound personal betrayal" and required a compensation for the moral damage. Irons did not plead guilty, having said that she did nothing bad for her former partner. The woman added that Pillips's anguish could not be considered a reason for a lawsuit. The court agreed with Irons's arguments, but Pillips refused to give up and filed an appeal. The Illinois Appeals Court has finally acknowledged the rightfulness of the deceived man. The court ruled that Sharon Irons had a sexual affair with Richard Phillips to obtain his semen. Oral sex eventually resulted in pregnancy, which is obviously impossible, and testifies to premeditated fraudulent intentions of the woman, the court said. The judge added, however, that it was not correct to accuse Irons of sperm theft. Ejaculation was a gift of the plaintiff. Furthermore, there was no agreement that the original deposit would be returned upon request, the decision said.
