Why would they be investigating, Libya isn't within their jurisdiction; they are neither ratified nor signatories.
I would figure that would raise more red flags and questions on why are they interfering in the affairs of a sovereign country that they have no right to collaberation with.

Genocide is a legality so I can see them looking into that but I guess it depends on what they or you mean by investigation anyway or rather how they intend to investigate.


This seems to be a reply to my post. They have the right to investigate as it was referred to the ICC by the UN Security Council, which is the only way a state which is not party to the treaty can fall under the jurisdiction of the ICC.

I'll have to take your word for it until I get some time.

I'd say, though, that the war is caused only by Qudaffi's unwillingness to vacate power, which has unfortunately caused military clashes. Qudaffi should be shot as soon as expedient. Although I don't know if the US should be involved. If I could though, I'd gladly give financial aid to the rebels in the form of semi-automatic rifles, preferably in the 7.62x51 range.

Okay, I have a little time so I will elaborate, my question with the ICC being able to judge a someone while ignoring jurisdiction comes from allegations being placed against certain US persons for war crimes yet the ICC can't do anything about it.

Mr. Stick Ball I wish I had some pictures of the north Ireland revolt, if they do start using the weapons in those pictures their country could slip into turmoil.

Well the USA can veto any referal from the security council and are not a state party so it's impossible for the ICC to investigate. In any case I don't think most the acusations levelled against G.Bush and co. are war crimes as such, they're about fighting an illegal war. The ICC is quite limited in its jurisdiction, it cannot investigate whether a war is illegal - only if actions during a war are war crimes.

Umm the rebels have organised a Government (Council) and have begun organising the protestors and defectors into a unified military. Also today it was reported that these rebels are indeed using the weapons pictured. The real question is once the Gaddafi is gone will the rebels unify and create a new Government or will they turn their guns on one another like Somalia did and slip into chaos!

I'm still not seeing why the government is performing so poorly in the fight. Libya had a WMD program until 2003, you'd figure they've invested enough in technology to beat some people like this, even if it isn't anywhere near "modern" military technology, if it was Soviet surplus or something

Why are they doing so badly fighting these rebels?

Lets see:

  • Command & Control is a total mess due to defections to the rebels
  • Rebels have high amounts of potent anti-Govt weaponry including MANPADs, tanks and rumored to even have SAM sites under control
  • Low morale (fighting ones own countrymen can't be good)
  • Rebels have a lot, and I mean a LOT of AA on their side. Every few pictures I've seen involved dual 12.5mm batteries on toyota trucks or something of that sort.

Essentially, the govt. has a few nice toys, and the rebels have the means and manpower to counter it. Aircraft can only do so much when your ATC's deserted, and you are facing heavy resistence of similar technology and capability levels.
