Well the USA can veto any referal from the security council and are not a state party so it's impossible for the ICC to investigate. In any case I don't think most the acusations levelled against G.Bush and co. are war crimes as such, they're about fighting an illegal war. The ICC is quite limited in its jurisdiction, it cannot investigate whether a war is illegal - only if actions during a war are war crimes.
